Please read these Terms and Conditions (“Terms”) carefully before accessing or using any service, website, mobile application, or platform offered by SIDVIR PRIVATE LIMITED, operating under the brand name UBIQCURE (“Company”, “we”, “us”, or “our”). These Terms govern your access to and use of www.ubiqcure.com and all associated mobile applications, portals, and services (collectively, the “Platform”).
By accessing the Platform, creating an account, subscribing to a service, or using any feature of the Platform, you (“User”, “you”, or “your”) agree to be legally bound by these Terms, our Privacy Policy, and any other policies or guidelines incorporated herein by reference. If you do not agree to these Terms, you must immediately cease use of the Platform.
2.1 Eligibility
The Platform is intended for use by individuals who are at least 18 years of age. Individuals below 18 years (“Minors”) may use the Platform only under the supervision and with the explicit consent of a parent or legal guardian. All school-related services (eHRC) require written/digital parental consent before any health data of a minor is collected or processed.
UBIQCURE reserves the right to suspend or terminate any account found to have been created without appropriate authorisation or in violation of these eligibility requirements.
2.2 Account registration and security
To access certain features, you must register an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Promptly update your information to keep it accurate.
- Maintain the confidentiality of your login credentials.
- Notify UBIQCURE immediately at support@ubiqcure.com of any unauthorised access or security breach.
UBIQCURE shall not be liable for any loss or damage arising from your failure to maintain the confidentiality of your credentials.
2.3 Services — general terms
2.3.1 Doctor Appointment
UBIQCURE acts as a technology platform enabling patients to book appointments with independent medical practitioners and healthcare facilities. UBIQCURE is not a healthcare provider, hospital, or medical institution. All medical advice, diagnosis, treatment, and prescriptions are solely the responsibility of the treating doctor or clinic. UBIQCURE does not guarantee the accuracy, completeness, or suitability of any medical professional’s advice. Appointment bookings are subject to availability. Cancellation and refund policies are governed by Section 3.
2.3.2 Virtual Clinic
The Virtual Clinic service enables patients to consult registered medical practitioners via video, audio, or text-based communication in accordance with the Telemedicine Practice Guidelines, 2020 issued by the Ministry of Health and Family Welfare (MoHFW), Government of India. You acknowledge that:
- Telemedicine has inherent limitations compared to in-person consultations.
- The RMP may decline to provide a prescription if, in their clinical judgement, a physical examination is necessary.
- Consultations are NOT recorded by UBIQCURE as per NMC Guidelines.
- In a medical emergency, you must immediately contact emergency services (108/112) and should not rely solely on the Virtual Clinic.
2.3.3 Health Test Booking
UBIQCURE facilitates the booking of diagnostic tests at empanelled diagnostic centres. The tests are conducted by independent third-party laboratories. UBIQCURE is not responsible for the accuracy of test results, sample handling procedures, or delays in result delivery attributable to the diagnostic centre. You are responsible for following all pre-test preparation instructions provided.
2.3.4 eHRC — Electronic Health Report Card
The eHRC service is a B2B subscription product available to schools. By entering into a Memorandum of Understanding (MoU) with UBIQCURE, the school (“Client Institution”) agrees that:
- It has obtained valid parental consent from the parent or legal guardian of each student before any health data is collected.
- The health data generated belongs to the student/parent and is held in trust by UBIQCURE as Data Fiduciary under the Digital Personal Data Protection Act, 2023.
- The eHRC report is a screening tool and not a comprehensive medical examination.
- Any Urgent Referral recommendation must be followed up with a registered medical practitioner.
2.4 Permitted and prohibited conduct
Permitted Use
- Accessing the Platform for personal, non-commercial health management.
- Booking appointments, consultations, and tests for yourself or minor children under your guardianship.
- Uploading and managing personal health documents for your own medical records.
- Using the Platform’s information resources for personal health awareness.
Prohibited Use
- Providing false, misleading, or fraudulent information to any doctor, nurse, or diagnostic centre through the Platform.
- Impersonating any person or entity, or falsely representing your affiliation with any organisation.
- Accessing or attempting to access another user’s account without authorisation.
- Using the Platform to transmit any unsolicited or unauthorised commercial communications (spam).
- Attempting to reverse-engineer, decompile, disassemble, or derive the source code of any component of the Platform.
- Uploading or transmitting any content that is unlawful, defamatory, obscene, or violates third-party intellectual property rights.
- Using automated tools (bots, scrapers, crawlers) to extract data from the Platform without express written consent.
- Any use of the Platform that violates applicable laws, including the IT Act 2000, DPDP Act 2023, or any other Indian or international law.
2.5 Third-party healthcare professionals and facilities
All doctors, nurses, clinics, hospitals, and diagnostic centres listed on UBIQCURE are independent third parties. UBIQCURE verifies credentials at the time of onboarding (including NMC/State Medical Council registration for all RMPs) but does not continuously monitor the ongoing licensure, performance, or conduct of these third parties. UBIQCURE does not employ these professionals and is not responsible for their clinical decisions, advice, diagnoses, prescriptions, or any outcomes of medical treatment. Any dispute regarding the quality of medical care must be addressed directly with the concerned healthcare professional or facility, and may also be referred to the appropriate State Medical Council.
2.6 Intellectual property
All content on the Platform, including but not limited to the UBIQCURE brand name, logo, design system, software, algorithms, health analytics models, eHRC report templates, website content, and all associated intellectual property, is owned by SIDVIR PRIVATE LIMITED or licensed to UBIQCURE by third parties. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for the purposes described in these Terms. You may not copy, reproduce, distribute, create derivative works from, or commercially exploit any Platform content without the prior written consent of UBIQCURE.
2.7 Disclaimer of medical advice
Important Medical Disclaimer
The Platform is not a substitute for professional medical advice, diagnosis, or treatment. All health information on the Platform, including AI-generated health tips, health score interpretations, and screening reports, is provided for informational and awareness purposes only. Always seek the advice of your physician or a qualified healthcare provider for any medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or seen on this Platform.
In a medical emergency, immediately call 108 or 112.
2.8 Limitation of liability
To the maximum extent permitted by applicable law, UBIQCURE, its directors, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including, without limitation, loss of health, physical injury, emotional distress, loss of revenue, loss of data, or loss of goodwill — arising out of or in connection with:
- Your use of the Platform.
- Any medical advice, diagnosis, or treatment provided by an independent healthcare professional accessed through the Platform.
- Any errors or omissions in any Platform content.
- Any unauthorised access to or alteration of your transmissions or data.
2.9 Indemnification
You agree to indemnify, defend, and hold harmless SIDVIR PRIVATE LIMITED and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; (d) any inaccurate or misleading information you provide to a healthcare professional through the Platform.
2.10 Modifications to the platform and terms
UBIQCURE reserves the right, at its sole discretion, to modify or discontinue the Platform or any part thereof at any time, with or without notice. We may also update these Terms from time to time. The revised Terms will be posted on the Platform with an updated “Last Updated” date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
2.11 Governing law and dispute resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Platform shall first be subject to good-faith negotiation between the parties. If the dispute is not resolved within 30 days of notice, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Lucknow, Uttar Pradesh, in the English language. The courts of Lucknow, Uttar Pradesh shall have exclusive jurisdiction over any legal proceedings.
2.12 Grievance officer
In accordance with the Information Technology Act, 2000 and the Consumer Protection Act, 2019, UBIQCURE has designated a Grievance Officer to handle complaints and queries:

2.13 Miscellaneous
- Severability: If any provision of these Terms is found to be invalid, the remaining provisions shall continue in full force.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and UBIQCURE with respect to the Platform.
- Waiver: UBIQCURE’s failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
- Force Majeure: UBIQCURE shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, government actions, pandemics, or internet failures.
- Language: These Terms are written in English. In the event of a conflict between the English version and any translation, the English version shall prevail.
